Terms of Service

1. Agreement

By using Visually ("Service"), you agree to these Terms. If you disagree, do not use the Service.

2. Account

You must be at least 14 years old, or the minimum legal age required to consent to the processing of personal data in your jurisdiction, whichever is higher. Users under this age may only use the Service with parental or guardian consent. You are responsible for maintaining your account security and all activities under your account.

3. Payments

Subscriptions are billed in advance (monthly or annually) via Paddle. You authorize recurring charges. Access to the Service requires an active subscription. Upon cancellation or expiration, access to the Service ends. Refunds are subject to our Refund Policy.

4. Your Content

You retain ownership of your content. You grant us a license to store and display it to provide the Service.

5. Prohibited Conduct

You may not: use the Service for illegal purposes; transmit viruses or malicious code; attempt to hack, attack, or disrupt the Service; engage in spamming or automated abuse; scrape or mine data; impersonate others; bypass security measures; or infringe on others' rights.

6. Image Libraries

We provide access to third-party image libraries and public domain sources for your convenience. Images are generally free to use, including for commercial purposes. Attribution is not required but appreciated. You may modify and edit images as needed.

You may not: depict identifiable people in a bad light or offensively; sell unaltered copies as posters, prints, or physical products; imply endorsement by people or brands in the imagery; redistribute or sell images on other stock photo or wallpaper platforms; use images as part of a trademark, design-mark, trade-name, business name, or service mark.

Your responsibility: You are solely and exclusively responsible for determining whether additional permissions, consents, or licenses are required before using any image, particularly for commercial use or images depicting identifiable persons, trademarks, or private property. We do not warrant that such consents or licenses have been obtained. We expressly disclaim any and all liability arising from your use of third-party content. Use of image libraries is at your own risk.

7. Limitation of Liability

The Service is provided "as is". We are not liable for indirect damages. Our total liability is limited to the amount you paid us in the past 12 months.

8. Termination

You may cancel anytime. We may immediately terminate or suspend your account without refund for violations of these Terms, including prohibited conduct. We reserve the right to disclose violations to appropriate authorities and pursue legal action.

9. Governing Law

These Terms are governed by Quebec law. Disputes are resolved in Quebec courts.
